Intellectual and industrial property
The site's own content (texts, design, logo, code and other elements) belongs to its owner or is used under licence, and is protected by intellectual and industrial property law. Reproduction, distribution or modification without express authorisation is not permitted, except where the law allows it.
The applications and materials users upload to the platform remain their property. By uploading them, users grant tengouna.app only the non-exclusive, limited licence needed to host, store, technically copy and publicly display them in order to provide the service.
Respect for third-party rights. Before publishing an application, users declare and warrant that:
- They are its author or hold all the rights and licences needed over the code, texts, images, trademarks, fonts, music, videos, databases and any other material it includes.
- The application is not a copy, clone or imitation of another application, website, brand or design that creates confusion or infringes its owner's rights.
- It complies with the licences of any third-party and open-source software it uses, including attribution and licensing obligations.
- It does not use works, trademarks, characters or elements protected by copyright or industrial property rights without their owners' authorisation.
Even if an application was developed with artificial intelligence tools, the user remains responsible for checking that the result does not infringe third-party rights.
Notice of infringement. If you are a rights holder and believe that any content hosted on tengouna.app infringes your rights, write to us at hablamos@tengouna.app stating: your identity and contact details, the work or right protected, the address (URL) of the content you consider infringing, an explanation of why it is infringing, and a statement that the information provided is accurate. We will review the notice diligently and, where appropriate, remove or block the content, giving the affected user an opportunity to respond.
Liability
Users' responsibility. The content and applications hosted on the platform are provided, controlled and published by the users themselves, who are solely responsible for their legality, origin, operation and security, as well as for any personal data they process through them and for complying with the regulations that apply to them. Users will be liable to tengouna.app and to third parties for any damages they cause by breaching this Legal notice or the law, and will hold the site owner harmless against claims, penalties and expenses (including legal defence costs) arising from it.
Platform disclaimer. tengouna.app acts as a hosting service provider and does not control or review users' content in advance. Therefore, and to the extent permitted by law, the owner is not responsible for the content, applications or links published by users, or for legal breaches, infringements of third-party rights or bad practices committed by them. In accordance with Article 16 of the LSSI-CE, the owner is not liable for information stored at the request of users provided it has no actual knowledge that it is unlawful and, if it does, acts diligently to remove it or block access to it.
Availability of the service. We aim to keep the site and the service continuously available, but we do not guarantee the absence of interruptions, errors or data loss. Users are advised to keep a backup of their applications. The owner is not liable for damage resulting from technical failures, force majeure or the actions of third parties outside the platform.
External links. The site and the hosted applications may contain links to third-party pages over which the owner has no control and for whose content it is not responsible.
Nothing in this section limits liability that cannot be excluded by law, nor the rights that belong to consumers and users.
Measures in case of breach
tengouna.app will actively pursue practices that go against this Legal notice. When it becomes aware of an infringement, whether through its own detection or a third party's notice, it may, without prior warning and without entitlement to compensation or refund:
- Immediately remove or block the affected content or application.
- Suspend or permanently cancel the infringing user's account, as well as any linked accounts used to circumvent the measure.
- Retain the necessary data and make it available to the authorities and rights holders when the law requires.
